Terms of Service

These Terms of Service ("Terms") apply when you book photography, videography, editing, or marketing/ads management services (the "Services") with GripShift ("we," "us," "our"), or use the gripshift.com.au website (the "Site").
1. Who We Are
GripShift is a Perth, Western Australia based photography and videography business, operated as a sole trader, providing:
Cinematic automotive and property photography and videography
Video editing and post-production
Meta (Facebook/Instagram) advertising management and content strategy on a retainer basis
2. Payment
A 50% deposit is required to lock in a booking date, with the remaining 50% due upon delivery of the completed work, unless otherwise agreed in writing.
Retainer services are billed monthly in advance.
There are no late fees. However, final work is watermarked and will not be released in full, unwatermarked form until payment is received in full.
3. Rescheduling
We're happy to reschedule a booking with reasonable notice. If you need to change your booking date, get in touch as early as you can so we can find a new time that works.
4. Deliverables and Revisions
Final deliverables (edited video, retouched images) are provided in the format and timeframe agreed at booking.
Up to two rounds of revisions are included. Additional revisions beyond this may incur a fee.
Raw, unedited footage and files remain the property of GripShift and are not included in deliverables unless separately agreed and paid for.
5. Usage Rights and Portfolio Use
GripShift retains copyright in all photographs and video footage produced, in line with the Copyright Act 1968 (Cth), unless otherwise agreed in writing.
Clients are granted a licence to use delivered final assets for the purpose agreed at booking (e.g. marketing, social media, website use, paid advertising).
GripShift may use delivered work, including results and performance data (such as views, engagement, or leads generated), in its own portfolio, case studies, and marketing materials, unless a client requests otherwise in writing.
Clients must not resell, sublicense, or claim delivered work as their own original creation for commercial resale, unless otherwise agreed.
6. Retainer Services
Retainer services (including Meta ads management) continue monthly until cancelled by either party with 30 days' written notice.
Where performance-based fees apply, these are based on agreed metrics and reporting (e.g. hook rate, watch-through rate, share rate, leads).
GripShift doesn't guarantee specific results (leads, views, followers, ROAS). Advertising performance depends on factors outside our control, including platform algorithm changes and market conditions. Past results shown in our marketing reflect real prior outcomes, not a promise of future performance.
7. Liability
To the extent permitted by law, GripShift's liability for any claim relating to the Services is limited to the amount paid for the Services in question.
Nothing in these Terms removes any consumer guarantee you're entitled to under the Australian Consumer Law that can't lawfully be excluded.
GripShift isn't liable for indirect or flow-on losses, except where the law doesn't allow that exclusion.
8. Website Use
Content on this Site (text, images, video, branding) belongs to GripShift and shouldn't be reproduced without permission, aside from personal, non-commercial viewing.
9. Changes to These Terms
We may update these Terms from time to time. Continuing to use our Services after an update means you accept the new Terms.
10. Governing Law
These Terms are governed by the laws of Western Australia, Australia.
